Military Justice Spotlight: February

The following information is a summary of Non-Judicial Punishments and administrative discharges given by commanders under Article 15 of the Uniform Code of Military Justice (UCMJ) in February 2014. The punishments are determined based on the individual facts and circumstances of each case.

Article 15s

A senior airman from the 723d Aircraft Maintenance Squadron failed to obey a lawful order by failing to report to the drug demand reduction center to give a urine sample. For this offense, the senior airman received a suspended reduction to airman first class, 10 days extra duty and a reprimand.

A senior airman from the 23d Component Maintenance Squadron used marijuana on two occasions. For this offense, the senior airman received a punishment consisting of a reduction to airman first class, suspended forfeitures of $1,017 per month for two months and a reprimand.

An airman first class from the 23d CMS did not report to work at the time required. For this offense, the airman first class received a reduction to airman basic, with a reduction below airman suspended, forfeiture of $765 pay per month for two months with one month suspended and a reprimand.

A staff sergeant from the 23d Comptroller Squadron hit a parked vehicle with his vehicle while driving and did not report it to the appropriate authorities. For this offense, the staff sergeant received a suspended reduction to senior airman, forfeiture of $250 pay per month for two months and a reprimand.

An airman first class from the 823d Base Defense Squadron assaulted a fellow airman by poking him repeatedly with his finger and by slapping him on his buttocks. For this offense, the airman first class received a reduction to the grade of airman, 30 days extra duty and a reprimand.

An airman first class from the 823d BDS assaulted a fellow airman by poking his food repeatedly with his finger and throwing a can of beer at him. For this offense, the airman first class received a reduction to the grade of airman, 30 days extra duty and a reprimand.

An airman first class from the 823d BDS drove under the influence of alcohol. For this offense the airman first class received a punishment consisting of a reduction to airman, 30 days extra duty, with 15 days of extra duty suspended and a reprimand.

Administrative Discharges

A senior airman from the 723d AMXS was discharged for Misconduct: Drug Abuse with an under honorable conditions (general) service characterization. This senior airman was discharged after receiving an Article 15 for wrongful use of marijuana.

A senior airman from the 23d Equipment Maintenance Squadron was discharged for Misconduct: Minor Disciplinary Infractions with an under honorable conditions (general) service characterization. This senior airman misused his Government Travel Card while not on official orders, failed to go to his appointed place of duty at the prescribed time, damaged government property, and disobeyed a direct order from his NCO in charge. Additionally, this senior airman was derelict in his duties on three different occasions and failed to complete a proper inventory.

A senior airman from the 23d Communications Squadron was discharged for Misconduct: Minor Disciplinary Infractions with an under honorable conditions (general) service characterization. This senior airman failed to report to his place of duty at the prescribed time on seven different occasions within 10 months.

An airman first class from the 23d EMS was discharged for Misconduct: Minor Disciplinary Infractions with an under honorable conditions (general) service characterization. This airman first class failed to report to his appointed place of duty at the prescribed time and when he did arrive, he was in civilian attire and was not within proper grooming standards. Additionally, this airman first class entered an off-limits business establishment, and he slept while on duty.

An airman first class from the 23d EMS was discharged for Misconduct: Minor Disciplinary Infractions with an under honorable conditions (general) service characterization. This airman first class failed to maintain her residence in a clean and orderly fashion, lied to a noncommissioned officer about her whereabouts, and disobeyed a direct order. Additionally, this airman first class failed to show at the time prescribed to her appointed place of duty on three different occasions.

An airman basic from the 723d AMXS was discharged for Misconduct: Drug Abuse with an under honorable conditions (general) service characterization. This airman basic was discharged after receiving an Article 15 for wrongful use of marijuana.

An airman first class from the 23d Aircraft Maintenance Squadron was discharged for Misconduct: Minor Disciplinary Infractions with an under honorable conditions (general) service characterization. This airman first class failed to report to his appointed place of duty at the prescribed time on 10 occasions. Additionally, this airman first class threatened to throw a soda bottle at his instructor and fell asleep on the wing of an aircraft.

A senior airman from the 23d Civil Engineer Squadron was discharged for Failure to Meet Minimum Fitness Standards with an honorable service characterization. This senior airman failed four physical fitness assessments in less than 20 months.
